If I submit a design patent and a fee transmittal form with no payment will I be billed for the patent? If yes do they submit the patent before payment to get a start on the process?
If you are referring to a U.S. Patent, the answer is NOT EXACTLY.
What you will receive is a Notice to file Missing Parts. It will say that you have a limited time (30 days from the mailing date of the notice I think) to send the required fees. I’m not sure if it will actually specify the required amounts or not).
